A MAN who refused to leave a kebab shop at closing time and then fell asleep on the pavement has been fined £50.
David John Collins, 43, of 23 Bellaire Drive, Barnstaple, pleaded guilty to being drunk and incapable when he appeared at North Devon Magistrates' Court on Friday.
David Barnes, for the prosecution, said police were called to Barum takeaway, in Queen Street, in the early hours of October 5 after reports a man was refusing to leave the shop.
When they arrived they found Collins asleep on the pavement with a doorman on top of him. When they were unable to revive him and send him home they decided to arrest him.
Collins, who represented himself, has other similar incidents on his record and told the court he was "really embarrassed" at the consequences of a "stupid night".
