SUBWAY STUNT: Daniel Mark Whiteley.

A MAN who urinated in a Subway restaurant says he has lost his job as a result of the police investigation.

Daniel Mark Whiteley, 26, of 15 Pottington Road in Barnstaple, pleaded guilty to using threatening behaviour at the takeaway on May 20 last year.

North Devon Magistrates' Court heard police were called to Subway in the early hours after reports that a man had urinated on the floor.

Lyndsey Baker, for the prosecution, said: "Staff said he had asked to use the toilets but they were locked after midnight.

"He said he would do it on the floor instead and proceeded to do so. When staff confronted him he became aggressive and other customers were shocked by his actions."

Whiteley, who was not represented by a solicitor, said he was very drunk and embarrassed by the incident.

He said: "I have lost my job now because when the police came to my house to find me they saw my work van and called my employers to see where I was."

Whiteley was given a six-month conditional discharge and ordered to pay £45 costs.
