The CPS decide based on the police file. Of course we don't know that the guy on the mobility scooter was using the crossing properly for the moment either. This could be the second time an elderly driver has been guilty of reckless driving in association with injuries/deaths caused at pedestrian crossings in the town.

I don't know who decides public interest. Anyone of any age who knocks down and kills someone on a pedestrian crossing should be punished equally - age should be irrelevant. If it was an 18-year-old who did this, everyone would be crying for him to be jailed; but if it is indeed a 79-year-old, he will get sympathy from the police/courts. Young drivers do dangerous things, but it's never a young driver when you hear stories of driving the wrong way down a motorway, mounting a pavement full of people or pressing the accelerator instead of the brake.

Sadly I had to rely on other news sources to realise the driver was a 79 year old himself, so it's likely he might be asked to surrender his licence and that will be that, doubt anything more is in the public interest (unless he was drunk or uninsured).
